Terms and Conditions

1. Introduction

Welcome to Maggie Wild Safaris & Adventure Trails (“we,” “us,” or “our”). By accessing and using our website (maggiewildsafaris.co.ke) and booking any of our services, you (“you” or “the client”) agree to be bound by these Terms and Conditions. Please read them carefully.

2. Booking and Payment

  • 2.1 Booking Process: Bookings can be made through our website, email, or phone. A booking is confirmed upon receipt of a deposit or full payment as specified in your booking confirmation.
  • 2.2 Deposit and Payment Schedule:
    • A non-refundable deposit of 30% of the total tour cost is required to secure your booking.
    • The remaining balance must be paid 30 before the tour’s departure date.
    • Full payment is required at the time of booking for bookings made within 30 days of the departure date.
  • 2.3 Payment Methods: We accept bank transfers, credit cards, and mobile money. The client is responsible for any transaction fees incurred.
  • 2.4 Currency: Unless otherwise stated, all prices are quoted in USD or KES.

3. Cancellation and Refunds

  • 3.1 Client Cancellation:
    • Cancellations must be made in writing via email.
    • Cancellation fees will be applied as follows:
      • 60 days or more before departure: 100% of the deposit refundable
      • 45 days before departure: 50% of the total tour cost
      • 30 days before departure: 100% of the total tour cost
      • Less than 15 days before departure: 100% of the total tour cost
    • No refunds will be given for unused portions of the tour.
  • 3.2 Company Cancellation:
    • We reserve the right to cancel a tour due to unforeseen circumstances, such as force majeure, insufficient bookings, or safety concerns.
    • In case of a company cancellation, we will offer a full refund or an alternative tour of comparable value.
  • 3.3 Force Majeure: We are not liable for cancellations, delays, or changes caused by events beyond our control, including, but not limited to, natural disasters, political instability, or pandemics.

4. Travel Insurance

  • 4.1 Mandatory Insurance: All clients must have comprehensive travel insurance covering medical expenses, emergency evacuation, trip cancellation, and personal liability.
  • 4.2 Proof of Insurance: Clients may be required to provide proof of insurance before the tour’s departure.

5. Health and Safety

  • 5.1 Health Requirements: Clients must meet all health requirements, including vaccinations and medications.
  • 5.2 Physical Fitness: Certain tours may require a specific level of physical fitness. Clients are responsible for assessing their fitness level and informing us of medical conditions.
  • 5.3 Safety Regulations: Clients must adhere to all our guides’ safety regulations and instructions.
  • 5.4 Wildlife Risks: Clients acknowledge the inherent risks of wildlife encounters and agree to follow our guides’ instructions.

6. Itinerary Changes

  • 6.1 Itinerary Flexibility: Itineraries are subject to change due to weather conditions, wildlife movements, or other unforeseen circumstances.
  • 6.2 Alternative Arrangements: In the event of itinerary changes, we will make reasonable efforts to provide alternative arrangements of comparable value.

7. Liability

  • 7.1 Limitation of Liability: We are not liable for any loss, damage, injury, or delay caused by the actions or omissions of third-party suppliers, such as airlines, hotels, or transportation companies.
  • 7.2 Personal Responsibility: Clients are responsible for their personal belongings and safety during the tour.
  • 7.3 Release of Liability: Clients may be required to sign a release of liability form before participating in certain activities.

8. Client Responsibilities

  • 8.1 Respect for Culture and Environment: Clients must respect the local cultures and environments they visit.
  • 8.2 Compliance with Laws: Clients must comply with all applicable laws and regulations of Kenya.
  • 8.3 Responsible Behavior: Clients must behave responsibly and respectfully towards other tour participants and our staff.

9. Photography and Media

  • 9.1 Use of Images: We reserve the right to use photographs and videos taken during the tour for promotional purposes unless the client requests otherwise.
  • 9.2 Client Media: Clients agree that the media they provide to Maggie Wild Safaris can be used for promotional purposes.

10. Complaints

  • 10.1 Complaint Procedure: Any complaints must be submitted in writing via email within 15 days of the tour’s completion.
  • 10.2 Resolution: We will make reasonable efforts to resolve any complaints promptly and fairly.

11. Governing Law

  • 11.1 Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya.
